The EU AI Act (Regulation 2024/1689, EUR-Lex) enters general-purpose AI force on 2 August 2026. For outbound sales teams using AI to generate, personalise, or automate cold email and cold calling, this is not a distant regulatory change. It is a compliance deadline with specific obligations that apply to the company sending emails — the deployer — regardless of which platform they use.

The common misunderstanding: "our platform vendor handles AI Act compliance." They do not. The EU AI Act's obligations for AI-generated content fall on the deployer — the company whose name is on the email, whose sales team configured the campaign, whose revenue operations team approved the send. The platform vendor provides the tools; the compliance is yours.

The three AI Act provisions outbound teams must understand

Article 50: Transparency for AI-generated content

Article 50 of the EU AI Act is the provision most directly applicable to AI-generated cold outbound. It requires that:

  1. Deployers of AI systems that interact with natural persons ensure that those persons are informed that they are interacting with an AI system, "in a clear and distinguishable manner" — unless the AI nature is "obvious from the context."

  2. Deployers of AI systems that generate content (text, images, audio) that is intended to inform or persuade must ensure the content is labelled as AI-generated "in a machine-readable format and as an AI-generated label."

For cold outbound email, Article 50 creates two practical obligations:

Disclosure in the email itself. A recipient of a cold email generated or significantly personalised by an AI system must be able to know that. Whether an AI-drafted prospecting email "obviously" comes from an AI is a judgment call that different supervisory authorities may interpret differently. The safe position — the position that survives a regulatory inquiry — is a disclosure in the email footer: "This email was drafted with the assistance of an AI system. [Company name] is responsible for its content and this campaign."

Machine-readable labelling. Article 50 also requires a machine-readable label. For email, this is implementable as a header or metadata field (e.g., X-AI-Generated: true) that email clients and compliance tools can parse. This is a technical requirement that most commercial sending platforms do not yet implement natively; buyers should ask vendors for their implementation roadmap.

The "obvious from context" exemption is narrower than it sounds. A recipient who receives a personalised email from a named salesperson at a company they have not heard of does not "obviously" know it was AI-generated. The exemption applies to clearly labelled AI chatbots, AI assistants that announce themselves, and contexts where the AI nature is disclosed in advance.

Article 14: Human oversight for AI systems with material risk

Article 14 requires that AI systems categorised as high-risk (or that operate in contexts where their decisions have material consequences for natural persons) include the capability for a natural person to effectively oversee, understand, interrupt, and override the system's decisions.

Cold outbound AI systems are not automatically classified as "high-risk" under Annex III of the AI Act — high-risk classification applies to systems in areas like employment, credit, law enforcement, and healthcare. However, Article 14's spirit extends to any AI system making decisions at scale that affect natural persons, and the transparency provisions of Article 50 apply regardless of risk classification.

For outbound teams, Article 14's practical implication is: human approval before mass deployment. A campaign-approval workflow where a human reviews and signs off on the campaign configuration (ICP, messaging, target list, sequence) before the AI executes at scale is both a defensible compliance practice and good operational hygiene. What does not satisfy Article 14: a checkbox that a human approved the platform six months ago. What does satisfy it: a documented, per-campaign or per-configuration-change approval by a named human, timestamped and retrievable.

GDPR Article 22: Automated individual decision-making

GDPR Article 22 restricts automated individual decision-making that produces legal or "similarly significant" effects on a data subject. This provision interacts with AI outbound in ways that are frequently underestimated:

Lead scoring and suppression decisions. If your AI SDR system automatically classifies a contact as "not interested" based on reply sentiment and suppresses them from all future outreach without any human review, this may constitute automated individual decision-making under Article 22. The contact has been denied the opportunity to engage with your company on the basis of an algorithmic classification they cannot contest.

The safe path: human review of suppression and disqualification decisions above a volume threshold, or a documented notice to contacts that automated classification decisions can be contested (right to explanation, right to human review).

How the three instruments interact

The EU AI Act, GDPR, and the ePrivacy Directive are separate instruments that apply concurrently. They do not override each other; they stack.

An outbound email is simultaneously: a marketing communication (ePrivacy), personal data processing (GDPR), and — if AI-generated — an output of an AI system subject to AI Act transparency (Article 50). Compliance requires satisfying all three layers, not just one.

Practical compliance checklist for outbound teams

Before running an AI-generated outbound campaign to EU contacts from August 2026:

AI Act obligations:

  1. Configure the Article 50 disclosure footer. Include in every AI-generated or AI-drafted email: "This email was drafted with the assistance of an AI system. [Company name] is responsible for its content." Log that the footer was included per send.
  2. Implement machine-readable labelling. Ask your platform vendor for machine-readable AI-content labelling support. If unavailable, maintain a campaign-level log of AI-generated sends.
  3. Document per-campaign human approval. Before any AI campaign deploys at scale, record: who approved it, when, and against what configuration. This is the Article 14 oversight record.
  4. Define an override protocol. Document how a human can stop, modify, or override the AI system mid-campaign. The protocol must be accessible to the person responsible for the campaign, not just the platform administrator.

GDPR obligations (interacting with AI Act):

  1. Complete a Legitimate Interest Assessment. Document the purpose test, necessity test, and balancing test for the campaign. Include in the balancing test: the automated nature of the personalisation, the scope of the send, and the data minimisation controls in place.
  2. Audit the personalisation data payload. Confirm that only minimally necessary data is passed to the AI model for personalisation. Remove profile fields beyond the specific signal that justifies the outreach.
  3. Verify cross-campaign opt-out propagation. An unsubscribe in one AI-generated campaign must suppress the contact from all subsequent AI-generated campaigns. Test before deployment.
  4. Document sub-processors. List every service in the AI outbound stack — model provider, email delivery, data enrichment — in your privacy notice. Update the list before the campaign if any new tool has been added.

ePrivacy obligations:

  1. Validate lawful basis by territory. Confirm the legitimate interest basis is defensible for each target member state. Germany (§ 7 UWG), Italy, and Spain have stricter local implementations than Ireland or the Netherlands.
  2. Include unsubscribe at first contact. Opt-out mechanism must be present in the first email, not only after follow-up attempts.

What "deployer responsibility" means for your organisation

The EU AI Act explicitly distinguishes providers (companies that develop and supply AI systems) from deployers (companies that use AI systems in their operations). The transparency and oversight obligations in Articles 50 and 14 fall primarily on deployers for the downstream use of AI systems.

Translated for outbound teams: your CRM, your sales platform, your model provider — they are providers. When you configure a campaign, approve it, and send it, you are the deployer. The AI Act compliance obligation for that campaign is yours, not your platform vendor's, even if the vendor has a "GDPR compliant" badge and a trust page.

One underappreciated benefit of getting EU AI Act compliance right is the signal it sends to AI search systems. Google's AI Overview and similar LLM-based search layers increasingly surface content that provides clear, authoritative answers to compliance questions — the kind of content that regulatory practitioners actually search for.

An outbound team that can credibly say "we are compliant with EU AI Act Article 50 and Article 14 for our outbound campaigns" — and can point to the documentation — has a trust signal that AI-assisted search systems recognise as authoritative. Does the EU AI Act apply to companies outside the EU sending cold email to EU contacts? Yes. The disclosure does not need to dominate the email or undermine its commercial purpose. A one-sentence footer identifying the AI-generated nature and naming the deployer company is the proportionate and practical approach. The machine-readable labelling requirement (also Article 50) is a separate technical obligation that is additional to, not a replacement for, the human-readable disclosure.

Does AI-assisted personalisation count as "AI-generated" under Article 50? The Article 50 obligation applies to AI systems that generate synthetic text, images, or audio intended to interact with or inform natural persons. An email where a human SDR wrote the template and an AI system inserted a personalised opening line based on a signal would likely trigger the disclosure obligation for the AI-generated portion. An email written entirely by a human with no AI involvement does not. The practical position for most outbound teams: if AI touched the content in any material way, include the disclosure. The risk of non-disclosure is higher than the risk of over-disclosure.

How does Article 14 human oversight interact with automated sequences that send without per-email human review? Article 14 does not require a human to review every individual email before it sends — that would make AI outbound operationally impossible. It requires that humans have the capability to oversee, understand, interrupt, and override the AI system's decisions. For outbound, the practical implementation is: human approval of the campaign configuration (ICP, messaging, sequence) before deployment; human access to an override mechanism mid-campaign; human review of aggregate outcomes (reply rates, opt-out rates, objection patterns) on a defined cadence. Individual-email review is not required; campaign-level oversight is.
